PLEASE READ THIS ENTIRE AGREEMENT BEFORE COMPLETING YOUR RESERVATION AS YOU ARE AGREEING TO BE LEGALLY BOUND TO THESE CONDITIONS.

YOU AGREE YOU ARE AT LEAST 18 AND HAVE A DRIVER'S LICENSE

YOU AGREE TO PROVIDE A BOATER'S SAFETY CARD IF YOU WERE BORN SEPTEMBER 1, 1993, OR AFTER ACCORDING TO THE STATE REQUIREMENTS TO OPERATE A VESSEL

Texas has a mandatory education law for certain boaters. All boaters born after August 31, 1993, must complete a TPWD-approved course and be certified with the TPWD to operate:

Any vessel over 15 horsepower.

Any windblown vessel over 14 feet.

All personal watercraft

Additional Information

Exemptions for those born after August 31, 1993, include:

Boaters who are residents of another state that have passed a TPWD-approved course in another state

Submitting a reservation and failing to complete/obtain the Texas Boater Safety Card will result in forfeiture of all monies paid and cancellation of the reservation with no future rescheduling. It is your responsibility to obtain the card.

IT IS YOUR RESPONSIBILITY TO OBTAIN THE CARD PRIOR TO THE START OF YOUR RENTAL. ABSOLUTELY NO REFUNDS OR RESCHEDULING WILL BE PERMITTED SHOULD YOU FAIL TO OBTAIN THE CARD - THERE CAN BE NO EXCEPTIONS. TO OBTAIN THE CARD, COMPLETE THE COURSE ONLINE AT: HTTP://BOAT-ED.COM/TEXAS/

LESSEE AGREES THAT SWIMMING IS AT THEIR OWN RISK

LESSEE AGREES THAT LESSEE AND ALL GUESTS ARE -REQUIRED- TO WEAR A LIFE JACKET/VEST AT ALL TIMES WHILE ON THE WATER. THIS INCLUDES WHILE TUBING OR USING ANY OTHER WATER TOYS. THERE CAN BE NO EXCEPTIONS.

LESSEE AGREES THAT RESERVATIONS ARE NON-REFUNDABLE FOR ANY REASON

LESSEE AGREES THAT NO CHANGES TO A CONFIRMED RESERVATION WILL BE PERMITTED FOR ANY REASON UNLESS APPROVED BY MANAGEMENT

LESSEE AGREES THAT Jett Ski Rental MAY SUBSTITUTE A WATERCRAFT EQUAL TO OR BETTER THAN THE ONE RESERVED DUE TO MECHANICAL ISSUES, LATE-RETURNING CUSTOMER OR FOR ANY OTHER REASON AT THE SOLE DISCRETION OF Jett Ski Rental.

LESSEE AGREES THAT PRODUCT IMAGES ON THE Jett Ski Rental WEBSITE ARE REPRESENTATIVE ONLY.

LESSEE AGREES THAT Jett Ski Rental DOES NOT GUARANTEE THE MAKE AND/OR MODEL/YEAR/COLOR OF ANY WATERCRAFT.

AGE REQUIREMENT:

LESSEE must be at least 18 with a valid driver's license and a major credit card in their own name. See information on requirements to operate a vessel at

CANCELLATIONS

Once your reservation is booked and payment is processed, there are no refunds.

NO-SHOW POLICY:

There are absolutely no refunds for no-shows. Failing to appear for your rental on the date and reserved time will result in loss of all monies paid. Payments made cannot be credited towards a future rental or charter.

RAIN CHECKS

Rain checks are offered at the sole discretion of Jett Ski Rental. Rain checks are offered when weather conditions are dangerous (ie High winds, lightning, tornado warnings). Jett Ski Rental will not offer a rain check if conditions are merely not ideal, such as it being overcast or light misting. Rain checks are never offered in advance.

Rain checks are NOT issued by our Reservations Department. Please do not contact them to request a rain check as they are not authorized to issue one. Rain checks are issued by the Jett Ski Rental location manager at the marina on the date and time of your scheduled reservation ONLY. Please do NOT schedule any vendors who might charge a cancellation fee if your reservation is cancelled/postponed due to dangerous weather.

Jett Ski Rental is not responsible for your loss of monies paid to vendors (ie DJ, Catering). We will not entertain any requests for full or partial refunds for vendor cancellation penalties. When issued a rain check, it must be used within 365 days of purchase, or it will be forfeited.

Jett Ski Rental reserves the right to cancel this agreement due to inclement or impending weather, act of God, and/or for other reasons outside of Jett Ski Rental's control. In such an event, a rain check will be issued, per Jett Ski Rental's discretion.

Rain checks must be used at the marina location of your original reservation. We will not transfer your credit to another location on the same lake, or to another location on another lake which we serve. This policy applies to all of our boats, watercraft and party boat charters.

ALTERNATE CUSTOMER ACCOMMODATION

Jett Ski Rental's ability to provide a watercraft, if reserved, is contingent upon and subject to the return of the watercraft by the previous LESSEE in many cases, or any other cause beyond Jett Ski Rental's control. In such an event, a rain check or refund will be issued. Jett Ski Rental does not guarantee the make/model of any of our rentals. Jett Ski Rental reserves the right to move customer reservations to another boat/personal watercraft of equal or better value, at our discretion.

RESERVED TIME

If you fail to show for your reservation, it will be forfeited. Rental time starts at the time reserved. Please check in 30 minutes prior to your reserved time to complete paperwork and renter orientation. Time lost due to late arrival or early returns will not result in a refund or rain check.

DAMAGE/LATE FEES

Customer agrees to be fully responsible for payment of damage cost to Jett Ski Rental.

FUEL

Fuel is NOT included in our rental costs of non-charter boats, unless otherwise specified at the time of booking. Fuel is charged upon check-in at our Drop off location. The cost of fuel is based on the type of boat and number of hours of your rental.

DAMAGE DEPOSIT:

A valid credit card shall be retained and will be used to provide full compensation for the facility to return said rental in as good condition as when received. Compensation includes, but is not limited to, reimbursement of articles damaged, missing or broken. I authorize Jett Ski Rental to charge my credit card for these items in such cases. In the alternative, or in addition to the charges to my credit card, Jett Ski Rental, in its sole discretion, may demand that I pay such charges in immediately available funds such as cash or certified check. The amount available on the balance of the credit card shall in no way be considered a limitation on the amount of damages, reimbursements or rental charges owed to Jett Ski Rental. I hereby acknowledge and understand that the watercraft is without damages or defects including, but not limited to, dents, scratches, tears, stains and propeller damage. An inspection of the watercraft will be conducted by both parties prior to the start of the Charter whereby any existing damage will be noted and acknowledged in writing on the inspection form. Upon return of the Charter, Jett Ski Rental will conduct a final inspection. I will be held responsible and liable for the total cost of any and all damages to the Charter that were not noted during the initial inspection. Jett Ski Rental has up to 48 hours after the rental & prior to being rented again to discover and inform me of damage found.

MAXIMUM CAPACITY

Everyone that boards the boat, whether a caterer, DJ, or guest must be counted as a passenger. This is STRICTLY enforced as it's mandated by the Texas Parks & Wildlife Department and US Coast Guard stability allowances. It's not a Jett Ski Rental rule, so please do not ask us to bend it as it puts everyone at risk. Capacities of all boats is listed on our website. LESSEE agrees that the watercraft rented will not exceed the maximum-permitted occupancy and weight limitations.

RETURNING LATE

LESSEE agrees to pay late fees in the event the watercraft is not returned at the specified rental completion time. ONE HOUR FEE PER 30 MIN. to cover the cost of the person waiting on you. Over 1 Hour there is a 3-hour min. Example if you are 2 hours late will be billed got 2x hours+1 hour = Billed for 3 hours late fee.

RESCUE FEE

LESSEE agrees to pay $350 rescue fee for any rescue unrelated to watercraft manufacturer defect or mechanical failure.

CUSTOMER NEGLIGENCE

LESSEE agrees not to use, nor permit the use of the watercraft for any of the following: for any illegal/unlawful purpose, in a careless/negligent manner, while under the influence of liquor, narcotics and/or other illegal/unlawful substances, or by any other person not a signatory of this agreement, regardless if equally qualified or licensed. LESSEE acknowledges and accepts responsibility for the safe and proper use and lawful operation of the watercraft, and for the safety and welfare of all in LESSEE's party, other boaters and all other persons. IT IS AGREED AND UNDERSTOOD BY LESSEE THAT Jett Ski Rental shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the watercraft.

INDEMNIFICATION:

LESSEE further agrees to indemnify and hold harmless, Jett Ski Rental LLC, from, and against any and all claims for loss of or damage to property or injury to persons (including death or disability) resulting through the use, operation or possession of rented watercraft. LESSEE further agrees to indemnify and hold harmless should any loss or damages occur to any of LESSEE's (or anyone in LESSEE's party) personal property while carried in, or on, the watercraft, including loss or damage caused by fire, water, theft or any other cause whatsoever.

LESSEE expressly agrees to indemnify and hold harmless of, from, and against any and all loss, costs, damages, attorney fees and/or liability in connection with the enforcement of this agreement by Jett Ski Rental, including expenses incurred in collection or attempting to collect any damages caused or incurred by LESSEE, delinquent rent (and any and all other delinquent charges), and any damages incurred by Jett Ski Rental in the event of suit by Jett Ski Rental to recover possession of the watercraft and/or to enforce any of the terms, conditions and/or provision hereof. It is understood and agreed that the Jurisdiction of any action hereunder shall be Texas and venue for any action hereunder shall be Denton County.

In the event of any malfunction, breakdown, or if any defect is discovered after the acceptance of the watercraft, LESSEE will immediately report same to Jett Ski Rental. In such an event, continued use of the watercraft shall be entirely at LESSEE's risk and thus LESSEE assumes all liabilities of injury and damage to all persons and property that result from, or may become involved by its continued use.

CUSTOMER RESPONSIBILITIES

The rules and regulations contained herein and posted on the website, in the office of each location, on the watercraft, and/or the grounds by Jett Ski Rental are for the safety and welfare of all who use the watercraft and the facilities. LESSEE certifies that he/she has read and understands said rules and regulations, and further assumes the responsibility to see that his/her guests and other members of LESSEE's party will obey all such rules and regulations.

EXPRESS ASSUMPTION OF RISK - CAUTION!! READ CAREFULLY BEFORE BOOKING

LESSEE acknowledges that the operation or use of a watercraft has inherent risks that may lead to bodily injury or death. LESSEE, to his/her knowledge, has no health restrictions which would prevent LESSEE from participating in any activities or entering into this agreement. LESSEE agrees that he/she is renting, operating or using the equipment provided by Jett Ski Rental at his/her own risk and assumes all risk of injury, illness, damages or loss that may result from the operation.

COVENANT NOT TO SUE - CAUTION!! READ CAREFULLY BEFORE BOOKING

As part of the consideration for using the rented equipment, LESSEE promises not to sue or make a claim against Jett Ski Rental for any damage or loss suffered as a result of participation in the rental activities. It is the intent of this rental agreement to fully and completely release Jett Ski Rental from all claims.

LITIGATION

Should any term or condition of this agreement be held void or unenforceable, then that term shall be deemed severed from this agreement and the enforceability of the remainder shall not be affected and will remain in full force and effect. Time is of the essence as to the performance of all obligations in this agreement. The prevailing party in any litigation between the parties hereto shall be entitled to recover, as a part of its judgment, reasonable attorney's fees and costs of suit.

BEHAVIOR: While on Texas inland waters (the lake), the captain of your vessel (charter boat) is the authoritative decision maker in all scenarios and is governed by both State and Federal law, enforced by the local Denton County or Tarrant County Game Wardens. You will listen to and obey all of their directives. All laws that apply on land, also apply on inland waters. IF IT IS ILLEGAL IN THE STATE OF TEXAS, IT IS ILLEGAL ON OUR BOAT. Please do not make the mistake of bringing drugs on board, as the captain and crew will immediately report it to the local authorities and your boat will return to dock where they will be waiting. Please also make sure that you have a plan for that one person who threatens to end your trip prematurely due to unacceptable behavior. Threatening the captain or crew and/or violating these policies will result in immediate forfeiture of the rest of your trip.

INDEMNITY WAIVER AND RELEASE OF LIABILITY AGREEMENT - TEXAS

DISCLAIMER

This Waiver and Release is applicable to all renters, operators, passengers, and users of equipment provided by Jett Ski Rental (FOR PURPOSES OF THIS WAIVER AND RELEASE, THE TERM "Jett Ski Rental" INCLUDES ALL EMPLOYEES, AGENTS, REPRESENTATIVES, SERVANTS, ASSIGNS, SUCCESSORS, INSURERS AND SUBSIDIARIES OF Jett Ski Rental). If any other rental agreement is executed with this Release, the provisions of this Release will prevail over any clauses in the rental agreement that are inconsistent with this Release. The undersigned agrees that he/she is also signing this Release as the guardian or agent of undersigned's minor children and users of said rental equipment. Renter agrees that he/she will disclose to Jett Ski Rental all potential operators, passengers, and users of said rental equipment. Renter further agrees that in the event that he/she fails to notify Jett Ski Rental of all potential operators, passengers, or users of said equipment, or misrepresents the certifications of anyone between the age 16-18, he/she will be personally liable for any damages to the undisclosed individuals, EVEN IF SUCH DAMAGES ARISE OUT OF THE NEGLIGENCE OR FAULT OF Jett Ski Rental

EXPRESS ASSUMPTION OF RISK - CAUTION!! READ BEFORE SIGNING

The undersigned acknowledges that the operation or use of a watercraft has inherent risks that may lead to bodily injury or death. I further understand that I am not bound or required to participate in any of the activities presented to me but have willingly and voluntarily decided to participate. I have no health restrictions which would prevent me from participating in any activities or entering into this agreement. I realize that I am free to refuse to participate in any activities including those I feel uncomfortable with or which I feel cannot be completed safely by me. I knowingly and voluntarily assume all risk of injury, illness. damage or loss, both known and unknown. associated with the rental operation, or use of the watercraft or associated rental company. even if arising from the negligence, act, or omission of LESSOR, and assume full responsibility for my participation, EVEN IF THE RISKS ARISE OUT OF THE NEGLIGENCE OR FAULT OF Jett Ski Rental

WAIVER - RELEASE OF LIABILITY

By the execution of the Release, the undersigned agrees that Jett Ski Rental shall not be liable for any damages arising from personal injuries sustained by the operators or passengers of the craft, including any minor children under the undersigned's custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Jett Ski Rental The undersigned assumes full responsibility for any such injuries or damages which may occur and further agrees that Jett Ski Rental shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Jett Ski Rental SHALL NOT BE RESPONSIBLE FOR SUCH INJURIES, DAMAGES, LOSS OR THEFT, EVEN IN THE EVENT OF NEGLIGENCE OR FAULT BY Jett Ski Rental, whether such negligence is present at the signing of this Release or takes place in the future.

LIABILITY TO THIRD PARTIES

The undersigned hereby agrees that he/she will indemnify and hold harmless Jett Ski Rental for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and minor children under the undersigned's custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Jett Ski Rental, EVEN IF SUCH DAMAGES ARISE OUT OF THE NEGLIGENCE OR FAULT OF Jett Ski Rental

ACKNOWLEDGMENT OF WAIVER AND RELEASE

The undersigned states that he/she has had sufficient time to review the Waiver and Release and to ask any questions associated with said Release. The undersigned understands that employees and agents of Jett Ski Rental are not attorneys and will not provide legal advice as to the legal interpretation of this agreement. The undersigned further states that he/she has carefully read the foregoing Waiver and Release, knows the contents thereof, and has signed this Release as his/her own free act. The undersigned warrants that he/she is aware that he/she may rent, operate, or use equipment from another rental facility, but has chosen to rent, operate, or use equipment from Jett Ski Rental with the knowledge that signing this Release is a requirement for rental operation, and use of said equipment. THE UNDERSIGNED FURTHER WARRANTS THAT HE/SHE IS FULLY AWARE THAT HE/SHE IS WAIVING ANY RIGHT HE/SHE MAY HAVE TO BRING A LEGAL ACTION TO ASSERT A CLAIM AGAINST Jett Ski Rental FOR Jett Ski Rentals NEGLIGENCE.

INDEMNITY AGREEMENT

THE UNDERSIGNED AGREES TO INDEMNIFY, HOLD HARMLESS AND DEFEND Jett Ski Rental IN ANY MATTER AND FROM AND AGAINST ALL CLAIMS, DAMAGES, LOSSES, AND EXPENSES, INCLUDING ATTORNEY'S FEES ARISING OUT OF AND/OR RELATING TO THE RENTAL OPERATION AND USE OF ALL EQUIPMENT PROVIDED BY SAWS DOCK INCLUDING BY NOT LIMITED TO ANY NEGLIGENT, GROSSLY NEGLIGENT AND/OR INTENTIONAL ACT OR OMISSION OF Jett Ski Rental

IMPORTANT SAFETY NOTICE: IN-WATER ACTIVITIES ARE PROHIBITED AFTER SUNSET.

INCLEMENT WEATHER: No refunds are issued for negative weather conditions, including but not limited to heavy rain, unfavorable winds, temperature extremes or dangerous lightning. A rain check may be offered at the sole discretion of Jett Ski Rental.

TAXES: Sales and local taxes are subject to change. You will be assessed the sales tax that is in effect at the time of your event departure date, regardless of when your reservation was made.

WARNING: There are significant elements of risk in any adventure, sports or activity associated with the outdoors, the presence of use of motorized watercraft and activities on, in and around water. Certain risks cannot be eliminated without destroying the unique character of the activity.

EXPRESS ASSUMPTION of RISK and RESPONSIBILITY: l/we assume the risk(s) of personal injury, accidents, illness, or death, including but not limited to sprain, torn muscles, and/or ligaments; fractures; eye damage; cuts, wounds, scrapes, abrasions and/or contusions, dehydration, drowning, exposure; head, neck, and/or spinal injuries; bites, stings and/or allergic reactions; shock, paralysis or death. I/we agree to assume responsibility for the risks identified above and any risk not specifically identified. My/our precipitation in this activity is purely voluntary. I/we verify that I have no health restrictions which would prevent me from participating in any activities, I am not under the influence of drugs or alcohol and sufficiently qualified and capable of participating in the activities. Therefore, I assume full responsibility for any injury that myself, my guest, and any minor children, whether mine or another of the participants, for bodily injury, accidents, illness, death, loss of personal property, and expense thereof as a result of any accident that may occur. We agree to hold you and your agents and employees harmless and waive any right of subrogation I/we may have. l/we elect to participate in spite of the risk.

THEREFORE, In consideration of the services or property provided, l/we for myself and any minor children for which I am responsible, and for any of my heirs, personal representatives or assigns RELEASE Jett Ski Rental LLC and their principals, directors, officers, agents, and employees AND STIPULATE that they shall have no liability of any nature for any and damages to me and the other persons and property I may use, as a result of any acts, omissions or negligence of Jett Ski Rental LLC or any other person or entity connected to those persons and entities, and hereby release, discharge and agree to hold Jett Ski Rental LLC and their insurer or other affiliates, if any harmless for any such damage.

COVENANT NOT TO SUE - CAUTION!! READ BEFORE SIGNING

As part of the consideration for using the chartered or rented equipment, I promise not to sue or make a claim against Jett Ski Rental, LLC for any damage or loss suffered as a result of my participation in the rental activities. It is the intent of this rental agreement to fully and completely release Jett Ski Rental, LLC from all claims.

I understand the NO LIFEGUARD will be on duty. I, and any minor children in my charge, will swim at our own risk.

By submitting a reservation online, in-person, or by phone, you agree to Jett Ski Rental Terms & Conditions, and agree to be bound by them.

TERMS & CONDITIONS ACKNOWLEDGEMENT

I further understand that the terms and conditions of this agreement contains the entire understanding between lessee and lessor and no other agreement, representation or inducement, oral or written, will be honored which is not included in this agreement, with the exception of the necessary Charter Rentals Policies, Terms & Conditions Agreement. I acknowledge and agree to be legally bound by the Jett Ski Rental Terms & Conditions Agreement when completing a reservation and/or submitting payment.

LESSEE understands that a signed INDEMNITY WAIVER AND RELEASE OF LIABILITY AGREEMENT is required for all rentals at the time of check in for reservation.

THE TERMS AND CONDITIONS OF THIS AGREEMENT CONTAINS THE ENTIRE UNDERSTANDING BETWEEN LESSEE AND Jett Ski Rental AND NO OTHER AGREEMENT, REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS AGREEMENT.

The policies contained herein do not apply to charter/party boats. A separate policy document applies to these boats. Lessee agrees to be legally bound to all of Jett Ski Rental Terms & Conditions.
